The names of the legal and commercial business must be registered with the state of its functioning. To receive an application for registration of business name, you can contact your state department that handles this service. For example, in the State of Maryland Department of Assessment and Taxation offers this service. You must fill out an application and mail it to the appropriate office in your state with a check or money order for the taxes owed.

Before completing the application for registration of name, please call and check availability of the name you chose. Find out if any other company is using the name of your area (or even in another part of the country). Many offices are now computerized, someone might be able to quickly check the name of the computer and let you know immediately if that name is already used by another business in that state. If you have Internet access, you may be able to check the availability of name for yourself. However, all State agencies do not provide the service availability of computerized name. If this name is not used by another company, the state will allow you to register and use the name you chose for the company's legal name. To subscribe, simply fill out the required paperwork and send it to the appropriate office.

Perform a search for prior art to discover whether the name is trademarked. You can contact a professional company brand to do the research yourself or you can do on your personal computer. Remember, do not use famous names.
